About the Case


In State v. Evans, the Commission conducted a hearing on September 9-10, 2019 for claimant Kenneth Evans, State v. Kenneth Leon Evans (Franklin – 93 CRS 2261-2263).

The Commission concluded in that there was sufficient evidence of factual innocence to merit judicial review. This case was referred forward for a hearing before a three-judge panel. Please contact the Franklin County Clerk of Court regarding information about the three-judge panel.

The documents presented at the Commission hearing became public record and are included here. The court sealed some documents from the public record.

The three-judge panel was held in Franklin County August 17-18 and October 12, 2020. At the conclusion of the hearing, the three-judge panel ruled unanimously that Mr. Evans had not proven his innocence by clear and convincing evidence and relief was denied.
