State v. Womble

About the Case


In State v. Womble, the Commission conducted a hearing on June 2 and 3, 2014. The Commission voted unanimously that there was sufficient evidence of factual innocence to merit judicial review. At that time, the case was referred to a three-judge panel.

The three-judge panel hearing was held in Granville County on October 17, 2014. The parties chose not to present additional evidence and offered the Commission’s hearing documents as evidence. The District Attorney and the Defense Attorney agreed that the evidence showed that Mr. Womble was innocent and they jointly asked the three-judge panel to vacate the conviction and exonerate Mr. Womble. The three-judge panel ruled that Mr. Womble had proven his innocence by clear and convincing evidence. Mr. Womble was exonerated.
