Start a claim with the North Carolina Innocence Inquiry Commission
Before applying you MUST read this VERY CAREFULLY:
DO NOT APPLY if:
You committed any of the crimes for which you were convicted: we will only investigate your case if you are totally innocent of all offenses. If you apply to us and we confirm that you did it, we must turn that evidence over to the district attorney’s office.
You committed the crimes for which you were convicted, but claim you have a defense: we will only investigate your case if you are claiming total factual innocence – meaning you did not do it, not that you did it but think you have a good excuse for doing it.
You were adjudicated delinquent as a juvenile and not convicted as an adult
Your case is pending and you have not been convicted yet
You were not convicted in North Carolina
You are making a claim on behalf of someone who has died
You are a family member or friend: the claimant themselves must apply. If there are issues with their ability to do so, please contact us.
You SHOULD APPLY if:
You were convicted in North Carolina
You were convicted of a class A-E felony or you were convicted as a habitual offender or must register as a sex offender because of your conviction (even if it was a misdemeanor)
You were convicted of involuntary manslaughter
You were convicted of COMMON LAW robbery
You were convicted of safecracking
You are claiming total innocence of all charges for which you were convicted
You have evidence that was NOT heard already at trial or that you DID NOT know about before you pleaded guilty
